Eviction Due to Need in Turkey
The Turkish Code of Obligations 6098, which entered into force on 1 July 2012 in our country, abolished Law No. 6570 on Real Estate Rents.
If the lessor himself, his spouse, descendants, descendants, or dependents have a housing need, he can file an eviction lawsuit for need within 1 month from the end of the lease agreement in fixed-term contracts, and within 1 month from the specified date, in accordance with the termination periods in the law for indefinite-term contracts.
The need here must be genuine and sincere. For example, it is real and sincere for a grown-up or married child to want to live in this house. The need for a workplace should be for a profession or art to be performed by the same people. Again, according to the decisions of the Supreme Court, the need must be continuous and compulsory.
For example, if the lessor has a vacant house in another place, this situation is considered as not necessary, or the same is true for a short-term need. There are deadlines in the law for filing this lawsuit.
After this lawsuit, the lessor cannot rent the house to another person within 3 years unless there is a justifiable reason. If he gives and the tenant sues for this reason, he is obliged to compensate the damage suffered by the tenant.
